Until I read Omni's comment on the photo above, I was going to say that - but it's of a different gun that most certainly HAS been damaged by overpressure in the top chamber.

No luck today guys/gals as rain moved in all morning and hopefully I can head out tomorrow am. I did get an e-mail from mark and as stated in the e-mail he has to produce his gun to his insurance co (USSA) which I never heard of until I googled it.

He told me since he has all his insurance with them (cars,house,health,etc) and they want the gun for some reason. I replied e-mail that under no circumstances do you give anyone else that gun.

Back in the middle 70's when I bought a 340 wtby, a good buddy of mine drilled the scope into his right eye and as of today you can still see the outline of the scars. But under his health policy he did say the rifle was his and that was it. Insurance covered his eye and it was a done deal.

He is going to see a lawyer on tuesday and go from there, now my question is if anyone one got hurt using a firearm and had trouble with the insurance co, let us know your results. Remember these were handloads.

Just an update on this, after Mark went to his lawyer and showed him all the paperwork with the hospital, ins, etc. He has to turn his gun in to USSA ins company in order to be covered for the health part for the same ins co.

The insurance co will then send the gun to S&W to be destroyed and melted down. The reason being that the gun in question is deemed unsafe and must be returned to the place of manufacture.

All I can say is wow, I never dealt with something like this especially that he has a 3 day time frame in order to ship the gun to the insurance co.

well that seems fair to destroy it as long as they dont decide to start sueing S&W for the trouble or they will have to make changes and stuff up a good product to keep the lawyers happy.

Yup, no lawsuit at all since it was handloads. Everyone is doing fine now and will head back to the range.

That makessesne to me. The insurance company wants to MAKE sure it is a legit claim and that itis/was not a result of manufacture. This way if it is a manufacturing defect then the maker will have to re-imburse(sp?) the insurance company. And it may come to passthat new revolver may find it's way to the folks. The importantthing here folks....is that everyone was able to be present at home and no one was "called" "Home!"
