Alaska... one in a billion photo. The photo was taken at the entrance to Katlian Bay at the end of the road in Sitka , Alaska . The whale is coming up to scoop up a mouthful of herring. The kayaker is a local Sitka Dentist. He apparently didnt sustain any injuries from the terrifying experience. The whales mouth is fully open with the bottom half under the boat. Photoshop I think.
The whale know that a thing (the kayak) that is inedible to it is floating at the surface, both by echo and the silhouette, so the chance for it to surface with its delicate mouth under the kayak would be almost none.

Even if it did happen there is no way the kayaker was in any danger. The worst that could happen is that he would be up ended in the water. Now if it was a sperm whale...
